The Jilly Box Market E-Gift Card Terms of Use & Disclaimer

1. Applicability and Scope
These E-Gift Card Terms of Use (“Terms”) govern the purchase, holding, and redemption of The Jilly Box Market E-Gift Cards (“E-Gift Cards”) issued by The Jilly Box Inc. (“we”, “us”, “our”).

E-Gift Cards can be used on products sold in The Market at jillybox.com.

E-Gift Cards cannot be used toward The Jilly Box Seasonal Boxes or any related charges.

2. Currency and Value
All E-Gift Cards are issued and denominated in Canadian dollars (CAD) and may only be redeemed in CAD. No currency conversion is offered. No fees of any kind apply to the purchase of an E-Gift Card.

3. No Expiry
E-Gift Cards do not expire and carry no dormancy or inactivity fees.

4. Activation and Payment
E-Gift Card balances are activated only upon successful clearance of payment. No balance is available for use prior to payment confirmation.

5. Redemption and Limitations
E-Gift Cards may be redeemed in whole or in partial amounts at checkout on The Market. Any remaining balance after a partial redemption stays on the E-Gift Card for future use.

E-Gift Cards may be combined with promotional discount codes at checkout, unless otherwise stated.

E-Gift Cards may not be redeemed for cash, in whole or in part, except where required by applicable law.

E-Gift Cards cannot be used to purchase other E-Gift Cards, cannot be reloaded, and cannot be resold or transferred for value.

6. Taxes
No sales tax is charged on the purchase of an E-Gift Card itself. Under section 181.2 of the Excise Tax Act, the issuance or sale of a gift certificate for consideration is deemed not to be a supply and therefore does not attract GST/HST. Applicable GST/HST/PST is charged when the E-Gift Card is redeemed toward a purchase, based on the applicable tax treatment for the customer’s location at that time.

7. Loss, Theft, and Unauthorized Use
E-Gift Cards have cash value and should be safeguarded accordingly. Ownership and risk of loss pass to the purchaser (or designated recipient) upon our electronic delivery of the E-Gift Card.

If you suspect an E-Gift Card has been lost, stolen, or copied, contact support@jillybox.com immediately. E-Gift Cards will not be replaced without proof of purchase.

8. Fraud and Resale
An E-Gift Card is void if copied, altered, resold, transferred for value, or reproduced without our written consent. We reserve the right to refuse or cancel any E-Gift Card suspected of being obtained, used, or applied fraudulently, unlawfully, or otherwise in violation of these Terms.

9. Returns and Cancellation
All E-Gift Card sales are final. E-Gift Cards cannot be returned, cancelled, or refunded once purchased, except where required by applicable law.

10. Amendments
We may update these Terms from time to time. Material changes will not affect the validity, value, or no-expiry status of previously issued E-Gift Cards.

11. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, except as set out below for Quebec consumers. For Quebec consumers, these Terms and any dispute arising from the E-Gift Cards are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.

12. Limitation of Liability
E-Gift Cards are provided on an “as is” basis. We make no warranties, express or implied, with respect to E-Gift Cards, including without limitation any implied warranty of merchantability or fitness for a particular purpose. We are not liable for any direct or indirect loss, damage, injury, claim, or liability of any kind arising from or related to an E-Gift Card or its use. If an E-Gift Card is found to be non-functional, or we are otherwise found liable to you, your sole remedy is replacement of the E-Gift Card or, where replacement is not possible, recovery limited to the last balance held on the E-Gift Card. Nothing in this section limits any warranty, right, or remedy that cannot be excluded or limited under applicable Canadian consumer protection law.
